1. Acknowledgement and Acceptance of the Terms and Conditions by the User.
1.1 Agreement.
TITAN MANAGER (“TM”) grants Users access to an online platform known as the “TITAN MANAGER Platform” (the “Platform”), which provides a variety of data and information related to the User’s investment portfolio. Users may access the Platform through the website titanmanager.io (and all other websites related to TM) (collectively, the “Site”) and through one or more TM mobile or web applications (the “Application” or “App”).
TM provides the Services subject to the User’s compliance with all terms and conditions, policies, and notices included or referenced herein (these “Terms and Conditions”), as well as any other written or electronic agreement between TM and a specific User. In addition, by using and accessing the Services, Users shall be subject to any guidelines, rules, or documentation posted (if any) applicable to such services or materials, which may contain additional terms and conditions. Such guidelines, rules, or documentation are hereby incorporated by reference into these Terms and Conditions.
By subscribing to, accessing, or using the Services, or otherwise accessing them, you indicate that you agree to be bound by these Terms and Conditions. If you do not wish to be bound by these Terms and Conditions, please leave and discontinue use of the Services.
1.2 Right of Modification; Binding Effect of Continued Use.
TM reserves the right to modify these Terms and Conditions at any time without prior notice to Users. Any modification or amendment shall become effective upon publication. The User acknowledges and agrees that it is their responsibility to review the Site, the Application, and these Terms and Conditions periodically. Continued use of the Services following any such modifications constitutes acceptance of the modified Terms and Conditions.
1.3 Non-Professional Use.
The Services are intended solely for individual Users acting for purposes unrelated to their trade, business, craft, or profession, as defined under Spanish Royal Legislative Decree 1/2007 of 16 November. Users may not subscribe to these Terms and Conditions on behalf of a company or other legal entity.
1.4 Use at the User’s Own Risk.
The Platform is a software- and information-based tool that provides certain financial information and facilitates investment and personal finance research. TM and its Affiliates do not act as financial or business advisors and do not provide advisory services. The Services are provided for informational purposes only and do not constitute advice. You should consult a qualified professional when such advice is required.
You are solely responsible for the information you input into the Platform, your investment decisions, and their consequences. TM does not recommend or endorse any specific investment strategy or securities. Rebalancing and valuation tools are provided solely for convenience and should not be used as the basis for trading or investment decisions.
TM and its Affiliates shall not be liable for any damages arising from economic losses, loss of profits, loss resulting from access or inability to access the Services, or reliance on information provided through the Services.
2. Definitions.
For purposes of these Terms and Conditions:
“Affiliates” means owners, employees, directors, affiliated companies and subsidiaries (including their employees and officers), suppliers, partners, sponsors, Data Providers, agents, and representatives of TM, including Apple and Google.
“Application” or “App” means any software application or web/mobile experience provided by TM to access the Platform.
“Data Providers” means third parties providing data, information, or content to TM.
“Content” means all materials available through the Services, excluding User Material.
“Services” means the Platform, Site, App, Content, Premium Features, support services, APIs, and any other services provided by TM.
“User”, “you”, or “your” means any person who accesses or uses the Services.
“User Material” means any content or data uploaded or provided by the User.
3. Services.
3.1 Access and Use.
Subject to these Terms and Conditions, TM grants you a limited, personal, non-exclusive, non-transferable license to access and use the Services.
3.2 Payments. Premium and Paid Features.
Certain features are available only through paid subscriptions (“Premium Features”). Fees, billing terms, and applicable conditions will be disclosed prior to purchase.
Discounted or trial access may require valid payment information. Unless cancelled during the trial period, subscriptions will automatically convert to paid plans.
3.3 Refunds; Payment Authorization; Cancellation.
TM does not offer refunds, as a free plan is available. Subscriptions may be cancelled via the account billing section. Billing is recurring and continues until cancellation.
All fees include applicable taxes. You authorize TM to charge your payment method and agree to keep billing information updated.
3.4 Third-Party Accounts and Data.
Users may link third-party accounts (e.g., Google, Facebook). You grant TM the necessary rights to access and process such data and are responsible for compliance with third-party terms.
3.5 Limitations.
TM may modify or discontinue the Services at any time. Temporary interruptions may occur. TM is not responsible for third-party network issues or Data Provider errors.
Services are provided “as is” and “as available,” without guarantees of accuracy, availability, or continuity.
3.6 Equipment and Requirements.
You are responsible for ensuring adequate equipment, connectivity, and access credentials. TM is not liable for third-party failures or data loss.
3.7 Reservation of Rights.
All intellectual property rights remain with TM and its licensors. No ownership rights are transferred to the User.
4. Electronic Contracting and Notifications; Complaints.
Electronic contracts are legally binding. Notices are effective upon sending or publication. Communications must be sent to [email protected].
5. User Requirements and Restrictions.
5.1 Accuracy and Security.
Users must provide accurate information and keep credentials secure.
5.2 Restrictions.
Users may not violate laws, misuse Services, distribute malware, infringe intellectual property rights, or engage in fraudulent or harmful conduct.
5.3 Age Requirement.
Users must be at least 18 years old.
5.4 Remote Monitoring.
TM may monitor usage via cookies. See the Cookie Policy for details.
5.5 Remote Deactivation.
TM may suspend or terminate access for non-payment or breach of these Terms.
6. Data and Privacy.
6.1 Privacy Policy.
User data is processed in accordance with TM’s Privacy Policy.
6.2 User Material.
Users retain responsibility for their content. TM may remove content at its discretion.
6.3 License.
Users grant TM a license to use User Material for service provision, improvement, research, and marketing in accordance with the Privacy Policy.
6.4 Public Access.
Certain information may be publicly accessible depending on settings and subscription level.
7. Termination.
TM may terminate access at its discretion for violations. Upon termination, access ceases immediately. Certain provisions survive termination.
8. Third-Party Sites and Information.
TM is not responsible for third-party materials. Use of such materials is at the User’s own risk.
9. Intellectual Property.
9.1 TM Ownership.
All Services are protected by intellectual property laws. Unauthorized use may result in legal action.
9.2 Feedback.
User feedback is licensed to TM on a royalty-free, worldwide, irrevocable basis.
10. User-Submitted Information.
10.1 User Material Responsibility.
TM is not responsible for loss or corruption of User Material.
10.2 Copyright Infringement Claims.
Claims must be submitted with sufficient identifying and contact information.
11. Warranties.
Services are provided “as is” and “as available,” subject to applicable law. TM does not guarantee uninterrupted or error-free service.
12. Limitation of Liability.
TM shall not be liable for indirect, incidental, consequential, or punitive damages. Some jurisdictions may not allow such exclusions.
13. Indemnification.
Users agree to indemnify TM against claims arising from misuse, violations, or User Material.
14. International Use.
TM does not guarantee compliance with laws outside Spain. Users are responsible for local compliance.
15. Governing Law and Jurisdiction.
These Terms are governed by Spanish law. Disputes shall be submitted to competent Spanish courts. Users may access the EU Online Dispute Resolution platform.
16. Entire Agreement.
These Terms constitute the entire agreement between TM and the User.
17. General.
17.1 Assignment.
TM may freely assign its rights and obligations.
17.2 Force Majeure.
TM is not liable for events beyond its reasonable control.
17.3 Severability.
Invalid provisions shall not affect the remainder.
17.4 No Waiver.
Failure to enforce any provision does not constitute a waiver.
